Respondents This court made the following :
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.42190 OF 2016 ORDER :
Heard learned counsel for the petitioner and Sri T.Sudhakar Reddy, learned Standing counsel for the respondents. 2.
Petitioner claims to be the owner of Plot No.67, Padmavathi Nagar Colony, Vanasthalipuram, Hyderabad. Petitioner was granted 15 mm water supply connection bearing CAN 614234790. Petitioner applied for higher capacity water supply i.e., 20 mm on 07.05.2016 by paying the requisite fee. On 19.07.2016 revised orders are passed acceding to the request of the petitioner. Alleging that though orders are passed, the revised water connection is not provided to her, this writ petition is filed. 3.
Learned Standing counsel submits that the provision of higher capacity water supply line requires cutting of the public road and therefore, Water Board has to apply for permission, from the Municipal Corporation to cut the road. As per the procedure envisaged under the Greater Hyderabad Municipal Corporation Act, the Corporation requires six weeks time to process such request as notices has to be given to the people in the locality, call for their objections and only after considering the objections, permission can be granted. He would therefore, submit that such process requires sufficient time.
4.
It appears so far no such efforts are made by the respondent-Board and was sitting tight on the issue without just cause or reason. However, as it is contended that the Municipal Corporation requires six weeks time to grant permission,
respondent-Board is directed to apply to the Municipal Corporation for grant of permission forthwith and soon after permission is granted, to take further course of action to provide water connection in terms of the order passed on 19.07.2016. The competent authority, shall pursue the matter with the Municipal Corporation to secure the permission. The entire exercise shall be completed within a period of two (2) months from the date of receipt of copy of this order.
5.
With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
