THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 34570 OF 2016 O R D E R :

The main grievance of the petitioner is that the 3rd respondent authorities, at the instance of the defendants in O.S. No. 257 of 2016 on the file of the Court of the Additional Junior Civil Judge, Kukatpally at Miyapur, have been interfering with the construction activity being undertaken by him, in accordance with the approved sanctioned plan, dated 25.05.2016. It is the case of the petitioner that the subject land was got regularized on 31.08.2013, as per the scheme announced through G.O.Ms. No. 902, dated 31.12.2007, as amended by G.O.Ms. No. 113, dated 31.01.2008.

Heard Sri P. Gangarami Reddy, learned counsel for the petitioner as well as Sri Sampath Prabhakar Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation. The grievance of the petitioner being limited, to meet the ends of justice, without going into the merits of the matter, Respondents 2 and 3 are directed not to interfere with the construction activity being undertaken by the petitioner as long as the approved sanctioned plan accorded in his favour is subsisting. However, this order does not preclude the respondents from taking necessary action against the petitioner, in accordance with law, if there are any deviations from the sanctioned plan. With this, the Writ petition stands disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
