THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7577 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.86 of 2022 on the file of Sujathanagar Police Station, B-Kothagudem District, registered for the offences punishable under Sections 354, 354(A) and 306 of the Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against this petitioner is that he had taken the victim along with him to the house of A2 and tried to commit rape. Humiliated by the said act of this petitioner and A2, the victim committed suicide.

This petitioner was arrested on 05.08.2022 and sent to prison. The allegation in the complaint is that he tried to outrage the modesty of the defacto complainant. As seen from the Remand Report, nearly 7 circumstantial witnesses were examined apart from the official witnesses who acted as inquest panchas and confession panchas.

Since the petitioner is in jail from 05.08.2022 and almost part of the investigation is complete, this petitioner can be granted the relief of bail subject to the following conditions: i) The petitioner/A1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate, Kothagudem.

ii) The petitioner/A1, after release shall appear before the concerned Station House Officer, on every Monday and Thursday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks, for the purpose of investigation. iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
