THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7578 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A7 in connection with Crime No.265 of 2022 on the file of Amberpet Police Station, Malakpet Division, Hyderabad, registered for the offences punishable under Sections 302, 324, 506 read with 34 of the Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of prosecution is that on 28.06.2022 there was a clash in between the complainant party consisting of four members and the accused persons who were seven in number. It is alleged that all the accused 1 to 7 threw stones against the complainant party. It is specifically mentioned in the Remand Report that Accused No.2 caught hold of the deceased by his neck and beat him with stone on his head and in the meantime, Accused No.3 beat him and kicked with legs. Except alleging overtacts against Accused Nos.2 and 3, there are no specific

overtacts against this petitioner except stating that he was part of the seven accused who threw stones on the complainant party. 4.

During the investigation, nearly seven witnesses both circumstantial and eye-witnesses were examined, recoveries were affected. For the reason of the investigation is almost complete, this petitioner can be granted the relief of bail subject to the following conditions:

i) The petitioner/A7 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of IV Additional Chief Metropolitan Magistrate, Hyderabad. ii) The petitioner/A7, after release shall appear before the concerned Station House Officer, every day between 10.00 A.M. to 1.00 P.M. for a period of thirty days, for the purpose of investigation.

iii) The petitioner/A7 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
