THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.10633 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.214 of 2025 of Musheerabad Police Station, Hyderabad District for the offences punishable under Sections 85 and 108 of BNS.

The brief facts of the case are that, on 31.07.2025, the defacto complainant, who is the mother of the deceased, lodged a report with the Police stating that her daughter was married to accused. Twenty days ago, her daughter called her son and informed him that her husband was threatening to marry another woman, alleging that she was not performing household work properly. On 30.07.2025, complainant along with her son, went to the martial house of her daughter to bring her back. Further, she stated that on 31.07.2025, they woke up and she asked her daughter to freshen up. Her daughter replied that she wanted some snacks. The complainant went to a nearby shop, and shortly thereafter, she heard her husband shouting. She immediately

rushed back to the house and found her daughter hanging from an iron bar using a saree. She alleged that her daughter was driven to suicide due to the instigating words of her husband, Sai, such as: "Go and die at your mother's house; I will marry again." and requested for necessary action. Basing on the same, the police registered case for the above offences.

Heard Ms. Sahithi Sri Kavya Mukkera, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that, apart from mere suspicion, there are no valid grounds to register a case against the petitioner for the alleged offences and that there are no specific allegations indicating that the petitioner abetted the commission of suicide. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the petitioner abated the deceased to commit suicide and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the petitioner is arrayed as the sole accused. As seen from the remand report, the allegation against the petitioner is that he abetted the deceased to commit suicide, which occurred at her matrimonial home. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Musheerabad Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 A.M., and 05:00

P.M., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
