The grievance of the petitioner in this case was that the police authorities were not taking action upon the letter dated 21.05.2011 addressed by the Deputy Executive Engineer, Roads and Buildings,

Sub-Division, Khammam, the 5th respondent, for removal of the Anjaneya Swamy idol erected in the road boundary of the KhammamBonakal road at Km.13/4-6. Relying on the written instructions received from the SubInspector of Police, Chinthakani Police Station, Khammam District, the learned Assistant Government Pleader for Home informed this Court that the villagers of Jagannadhapuram established the Anjaneya Swamy idol by the side of Khammam-Bonakal road during the night with the intention of constructing a temple. But, as there were complaints against the same, including one from the petitioner, the Roads and Building Department also inspected the site and found that the idol had been established on the road margin. The Roads and Buildings Department therefore requested the police to arrange to take action in the matter.

The Sub-Inspector of Police further stated that the idol was taken away from the disputed site and recently a temple was constructed in some other undisputed land where the idol was installed and that the disputed place is now vacant. In the light of the afore-stated developments, the cause in this writ petition does not survive.

The writ petition is therefore dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
