Heard learned counsel for the petitioner and the learned Government Pleader for Revenue.
The grievance of the petitioner is that the 3rd respondent is interfering with the land admeasuring Ac.1.00 gts in Survey No.439/A situated at Thimmareddypalli Village of Navabpeta Mandal, Ranga Reddy District and sought to be dispossessed him and forcibly acquire the said land for construction of houses to the poor people without initiating land acquisition proceedings and due process of law. The petitioner in his affidavit stated that his father earlier filed W.P.No.2770 of 2003, which was stated to have been disposed of directing the respondents to follow the due process of law. It is also stated that against the interference of private party, his father has already obtained a decree in O.S.No.51 of 1984 from the Subordinate Judge, Vikarabad, Ranga Reddy District.
Learned Government Pleader for Revenue states on instructions that if any action is intended to be taken on the petitioner's land, due process of law certainly be followed by the respondents.
In that view of the matter, the writ petition is disposed of directing respondents 2 and 3 to follow due process of law in the event of any action intended to be taken on the petitioner's land as aforesaid. There shall be no order as to costs.
