09.04.2025 JSR,J I.A.No.1 of 2025 This application is filed invoking the provisions of Section 484 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') seeking relaxation of the conditions imposed against the petitioner-accused No.3 while granting bail. Mr.

Chandrashekhar Yadav.

S, learned counsel for the petitioner submitted that the petitioner approached this Court and filed Criminal Petition No.10761 of 2024 for grant of regular bail and said petition was allowed on 26.09.2024 subject to certain condition. One of the condition that petitioner shall execute personal bond of Rs.20,000/- with two sureties to the satisfaction of the Sessions Judge, Hyderabad District. It is further submitted that petitioner due to financial difficulties could not execute the personal bond and since then he was in judicial custody. It is further contended unless the said condition is relaxed, the petitioner will be put to irreparable loss and hardship.

Mr.Syed Yasar Mamoon, learned Addl. Public Prosecutor has not disputed the same.

Taking into consideration the averments made in the application, submission made by the learned counsel for the petitioner, this Court deems it appropriate to dispose of the application by modifying the condition No.i in the order dated

OFFI CE NOTE 26.09.2024 that petitioner-accused No.3 shall be released on bail on his executing personal bond of Rs.10,000/- with one surety to the satisfaction of the Sessions Judge, Hyderabad District. However, the other conditions imposed by this Court will continue.

Accordingly, this application is ordered.
