THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.27303 OF 2006 ORDER:

This Writ Petition is filed seeking the following relief: "....to issue a Writ, order or direction particularly a Writ in the nature of Mandamus declaring the Notification No.G2/2876/2003 dated 27.08.2003 under Section 4(1) of the Land Acquisition Act published in East Godavari District Gazette dated 02.09.2003 and consequent declaration under Section 6 of the Land Acquisition Act vide Reference No.G2/2876/2003, dated 28.08.2003 published in East Godavari District Gazette on 05.09.2003 are lapsed by operation of Section 11-A of the Land Acquisition Act and consequently direct the Respondents not to interfere with the peaceful possession and enjoyment of the property of the Petitioner and his brothers to the extent of Ac.7-68 cents in Sy.No.54 of Gollapalem village, Kajuluru Mandal, East Godavari District and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

In the counter affidavit filed by the respondent it was asserted that the petitioner and four others have filed W.P.No.3265 of 2006 challenging the land acquisition proceedings issued under the impugned notification. It was also further stated that the petitioner also filed yet another Writ Petition No.27303 of 2006. Learned counsel for the petitioner on verification of the record fairly submits that the petitioner appeared to have filed the earlier writ petition and the said fact was not informed to him. It is also further submitted that the said writ petition was disposed of on 13.10.2006, where under the writ petition came to be disposed of with certain directions.

Inasmuch as, the grievance of the petitioner stands redressed in the earlier writ petition i.e., W.P.No.3265 of 2006, no further orders are required to pass. Hence, the writ petition is closed. There shall be no order as to costs. Consequently, the Miscellaneous Petitions pending, if any, shall also stand closed.
