The petitioner was appointed as a Fair Price Shop dealer of Shop No.5, Dhanthanoor Village, Kothakota Mandal, Mababubnagar District. The authorisation of the petitioner was extended from time to time and he was running the shop with valid authorisation. On 28.07.2015, the Deputy Tahsildar (Enforcement), Kothakota Mandal, along with Deputy Tahsildar, Wanaparthy, inspected the shop of the petitioner and found some variations and conducted panchnama. However, on the basis of the report submitted by the Deputy Tahsildar, Wanaparthy on 29.07.2015 the authorisation of the petitioner was suspended pending enquiry. Challenging the same, the present writ petition is filed.

It is represented by the learned counsel for the petitioner that a show cause notice was issued on 14.08.2015 and the petitioner submitted his explanation on 28.08.2015.

In the circumstances, what remained is an enquiry. This Court has carefully perused the allegations levelled against the petitioner and is of the opinion that the said charges require enquiry.

In the above circumstances, this Writ Petition is disposed of directing the third respondent to conduct an enquiry in respect of the allegations levelled against the petitioner and pass final orders thereon by giving due opportunity to the petitioner within a period of sixty (60) days from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. ________________________________ A.RAMALINGESWARA RAO, J 06.10.2015 MVA
