Heard Sri Y.Rama Rao for petitioner, Assistant Government Pleader for Panchayat Raj and Sri Cheemalapati Ravi for respondents 2 and 3.

The petitioner prays for the following relief :- " .... to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering there resolutions dated 10.05.2006, 04.02.2007 and 27.03.2008 passed by the Grampanchayat, Kotalaparru, Penugonda Mandal, West Godavari District, and also the objections of the villagers dated 27.03.2008 as illegal, arbitrary and violative of fundamental rights guaranteed under constitution of India and consequently direct the respondents to lay the road leading from Somaraju Cheruvu to Kotalaparru, Harijana Wada SC Colony, as per the resolutions of Grampanchayat dated 10.05.2006, 04.02.2007 and 27.03.2008 ...."

The respondents filed counter affidavit opposing the writ prayer.

Having regard to passage of time and particularly the submission of respondents 2 and 3, this court is of the view that the grievance need not be considered at this length of time. Further, the prayer virtually amounts to prioritizing administrative

exigencies by this Court. Hence, I am not inclined to exercise my discretion.

The writ petition fails and is accordingly dismissed. No order as to costs.
