HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.478 of 2014 ORDER:

This petition is filed to withdraw O.P.No.710 of 2014 from the file of Family Court, City Civil Court, Hyderabad and transfer the same to Family Court, Karimnagar for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of petition, according to which, her marriage with respondent was performed on 14.03.2009 at Vemulawada in Karimnagar District and that respondent looked after her well for sometime and thereafter started harassing both physically and mentally and finally she was driven out from the house and since then she is staying with her parents at her native village. She stated that she filed DVC No.6 of 2014 before Judicial First Class Magistrate, Vemulawada and after receipt of notice in DVC case, respondent filed O.P.No.710 of 2014 before Family Court, Hyderabad only with a view to harass her. She stated that it is difficult for her to travel from her village Lingampally of Vemulawada in Karimnagar District to Hyderabad for the purpose of defending O.P.No.710 of 2014, and for these reasons, she prayed for transfer of O.P. No.710 of 2014 from Family Court, City Civil Court, Hyderabad to Family Court, Karimnagar.

3. Respondent in spite of granting time for filing counter did not choose to file any counter though he made his appearance through advocate in September, 2014.

4. Heard arguments.

5 . Considering the reasons stated in the affidavit, which remained unchallenged and also considering the convenience of wife, O.P.No.710 of 2014 is withdrawn from Family Court, City Civil Court, Hyderabad and transferred to Family Court, Karimnagar for disposal in accordance with law.

6. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
