HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.3814 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home for respondent Nos.1, 2 & 7 in particular and the 3rd respondent-M/s. Chodavaram Cooperative Sugars Limited in general, leave about other respondents and perused the prayer in the writ petition with the supporting affidavit and other material on record including the counter affidavit of the 2nd respondent-SHO, Chodavaram.

Thus from the very prayer it is alleged inaction on the part of respondent No.2 in investigating the crime against the respondent Nos.4, 5, 6 & 8 among others if any.

In fact as per the very counter affidavit of the 2nd respondent, the crime was investigated and police file final report in the form of referred report on 17.09.2016 itself and the defacto complainant, who is the writ petitioner was also intimated about the same of the referred report of civil nature.

Having regard to the above and by recording the same, the Writ Petition is disposed of for nothing to keep pending, but for to work out any other remedies open to the petitioner including protest petition if not already filed.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
