THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20570 of 2016 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration, Sri M.Ajay Kumar, learned Standing Counsel for respondent No.2 and Ms.Pingali Laxmi, learned Standing Counsel for respondent No.3.

The present writ petition is filed under Article 226 of the Constitution of India, with the following prayer:

'For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ, order or a direction more particularly one in the nature of writ of mandamus declaring the action of respondents in not accepting the documents and application of the petitioner for construction of building permission as illegal, arbitrary, unconstitutional and against Articles 14 and 21 of the Constitution of India and pass such further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case'.

Learned counsel for the petitioner mainly submits that though he made an application to the authorities seeking permission for construction of building, the authorities have not accepted the same. On the other hand, learned Standing Counsel for respondent No.3 states that the question of considering the application would not arise as the petitioner proposed to construct a building on a road. It is further contended by her that till date no application is submitted and as such question of accepting the application does not arise. As seen from the record, the grievance of the petitioner appears to be that though he made every effort to submit his explanation, the authorities are not accepting the same and not even acknowledging it. Having regard to the above, the second respondent shall consider the acceptance of the application made by the petitioner seeking permission for construction of a building in land admeasuring 165 square yards of Waddepally Village, Kanamkonda Mandal of Warangal District,

if the same satisfies all the requirements of law and thereafter pass appropriate orders on the said application, in accordance with law. With the above direction, the writ petition is disposed of.
