THE HONOURABLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION NO.26293 OF 2019 ORDER:

The present Writ Petition is filed questioning the inaction of the respondents 2 to 4 with regard to the illegal construction made by respondents 5 and 6 by occupying public road in front of the petitioner's house, as being illegal, arbitrary and violation of principles of natural justice and for a consequential relief directing respondents 2 to 4 to take necessary action based on the petitioner's representations dated 30.10.2019 and 22.11.2019. Heard the learned counsel for the petitioner and Sri G.Narender Reddy, learned Standing Counsel for Gram Panchayat. Learned Standing Counsel would submit that the unofficial respondents (respondents 5 and 6 in the Writ Petition) have made an application to the fourth respondent for sanction of raising pillars in their existing old house and also for construction of compound wall. The receipt of the complaints/representations from the petitioner is also not disputed by the learned Standing Counsel.

Having regard to the fact that the petitioner has made representations to the authorities concerned on 30.10.2019 and 22.11.2019 with regard to encroachment on to the public road, which is the land for usage of the villagers, the authorities are hereby directed to consider and dispose of the said representations made by the petitioner before according permission, in accordance with law, within a period of two (2) weeks from the date of receipt of a copy of this order.

With the above direction the Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous applications, if any, pending shall stand closed.
