THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION Nos.6439 and 6442 of 2005 COMMON ORDER:
These two writ petitions arise out of the individual orders dated 28.02.2005 passed by the Labour Court, Guntur, in execution proceedings initiated in I.D.Nos.87 and 352 of 1992 respectively.
The ground of challenge was that the Awards passed by the Labour Court in the subject I.D.s were questioned before this Court by way of separate Writ Petitions which were dismissed and Writ Appeals against the said dismissal were still pending consideration. It was on this ground that the petitioner organization objected to the Labour Court, Guntur, proceeding with the Execution Petitions.
It is fairly stated by Ms.S.Madhavi, learned counsel representing Mr.C.Raghu, learned counsel for the petitioner organization, that the Writ Appeals filed against the Awards passed by the Labour Court, Guntur were also dismissed.
In the light of the Awards passed by the Labour Court, Guntur, attaining finality the petitioner organisation
can have no objection to the execution thereof, be it voluntarily or through the process of Court.
The Writ Petitions are therefore devoid of merit and are accordingly dismissed.
Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
