This appeal is preferred questioning order dated 07-09-2009 in I.A.No.1258/2008 in O.S.No.301/2008 on the file of IV Additional District Judge, Visakhapatnam.

Appellant is plaintiff in the above referred I.A.No.1258/2008 which was dismissed by the Court below, challenging the same, present appeal is preferred.

3. As per the submission of both sides, suit in O.S.No.301/2008 was disposed of on 25-01-2016 and in view of the disposal of the suit,

which was decreed in favour of the plaintiff, the relief claimed in this appeal has become infructuous.

3. Considering the submissions of both sides, appeal is dismissed as infructuous. No costs.

As a sequel, miscellaneous petitions, if any, pending in this appeal, shall stand dismissed.
