HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.32209 of 2015 ORDER:

This writ petition is filed seeking to declare the suspension order and charge sheet dated 20.08.2015 issued by the 2nd respondent as illegal and arbitrary.

The petitioner was appointed as Conductor in the respondentCorporation in 1997. While he was conducting the bus on 20.08.2015, a check was conducted and charge sheet was issued to him on the ground that he has collected the amount from a lady passenger, but did not issue the ticket. Simultaneously, he was placed under suspension. The suspension order is challenged in the present writ petition. Learned counsel appearing for the petitioner submits that the petitioner issued tickets to 46 passengers and the lady passenger also gave a statement that she had misplaced the ticket.

On the other hand, learned Standing Counsel appearing for the respondent-Corporation would submit that investigation report clearly indicates that one ticket was not issued to the lady passenger.

Since the order impugned is an order of suspension pending enquiry, it requires appreciation of evidence and I am not inclined to go into the merits of the case at this stage. Under these circumstances, the Writ petition is disposed of directing the respondents to complete the enquiry and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order, failing which, the

order of suspension shall stand revoked. No costs. Miscellaneous petitions pending, if any, shall stand closed.
