THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3759 OF 2016 ORDER:

The petitioners claim to be in possession of the lands admeasuring Ac.3-00 cents in R.S.Nos.24/6, 24/7, 24/8 and 24/9 situated at Singavaram Village, Denduluru Mandal, West Godavari District. It is stated that earlier two notices were given by the 4th respondent alleging that the petitioners are occupying assigned land. To the 1st notice dated 26-03-2013, the petitioners gave detailed explanation on 29-04-2013. Thereafter, another notice was given to the petitioners on 04-10-2015. The petitioners also filed explanation to the said notice on 19-10-2015. Now, it is alleged that while no orders are passed in pursuance of the earlier notices and the explanations, once again fresh notice is given to the petitioners on 01-10-2015. The present writ petition is filed alleging that the 4th respondent is trying to dispossess the petitioners from the lands in question, without passing appropriate orders on the earlier notices and the explanations given by the petitioners, referred to above.

Heard the learned Government Pleader for Revenue. Since it is apparent that the petitioners have filed explanations on two occasions pursuant to two identical notices, it is for the 4th respondent to take appropriate decision in the matter after considering the explanations of the petitioners and communicate his decision to the petitioners. The latest notice, referred to above, is similar to the earlier two notices referred to above.

Since the petitioners have given explanations to the two notices, referred to above, the 4th respondent is directed to consider the said explanations as a common explanation to all the three notices

and examine the petitioners explanations with reference to the records and take appropriate decision and communicate the same to the petitioners. However, till passing of appropriate orders by the 4th respondent, as directed above, the petitioners shall not be dispossessed from the lands in question.
