THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.1874 OF 2017 ORDER:

This criminal petition, under Section 439(1)(b) of Cr.P.C., is filed by the petitioner/A-1 to relax the condition imposed by the Metropolitan Sessions Judge-cum-I Additional District and Sessions Judge, Visakhapatnam, in Crl.M.P.No.255 of 2017, dated 03.02.2017, whereby the learned Metropolitan Sessions Judge while enlarging the petitioner on bail imposed a condition to furnish fixed deposits for an amount of Rs.50,000/- drawn in the name of the court besides execution of bond for Rs.50,000/- with two sureties.

According to the petitioner, the condition of furnishing fixed deposits for an amount of Rs.50,000/- is onerous. However, the petitioner is allegedly indulged in ganja business and in case the said condition is relaxed to a minimum extent, he may not bother to forego the deposit and thereby, there is every possibility of fleeing away from justice, avoiding trial. Therefore, considering the facts and circumstances of the case and the financial condition of the petitioner, the condition of furnishing fixed deposits for an amount of Rs.50,000/- by the petitioner is reduced to Rs.25,000/- (Rupees twenty five thousand only).

With the above modification, the Criminal Petition is allowed. Miscellaneous Petitions, if any, pending in this criminal petition shall stand closed.
