This petition is filed, seeking for quash of the proceedings against the petitioners, who are the accused, in C.C.No.807 of 2009 on the file of Judicial Magistrate of First Class, Suryapet, Nalgonda District. The offences alleged against the petitioners are under Sections 498-A and 326 IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.

A perusal of the record shows that the entire investigation is completed and charge sheet is also filed.

Hence, the petitioners have an alternative remedy of filing a discharge petition before the court below.

Accordingly, the Criminal Petition is dismissed granting liberty to the petitioners to file a discharge petition, if he so chooses.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
