HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.2007 of 2017 ORDER:

This writ petition is filed with the following prayer: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents more particularly the 3rd respondent in interfering with the civil dispute between the petitioners and the 4th respondent and directing the petitioners to vacate the house bearing D.No.13/314 situated at Adoni, Kurnool District as illegal, arbitrary, without jurisdiction and violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the 3rd respondent not to interfere with the civil dispute between the petitioners and 4th respondent in respect of the house bearing D.No.13/314 situated at Adoni, Kurnool District and pass such other order or orders which are necessary in the interest of justice."

Learned Government Pleader for Home, on the basis of written instructions, submits that, pursuant to the complaint of the 1st petitioner herein, a case was registered in Cr.No.182 of 2016 on 21.10.2016 against the 4th respondent herein and two others, for the offences under Sections 323 and 506 read with Section 34 IPC, wherein after completion of investigation, charge sheet was filed on 03.01.2017 on the file of the Judicial Magistrate of First Class, Adoni. It is further stated that the allegation of the petitioners that 3rd respondent is interfering in the civil disputes between the petitioners and the 4th respondent is false and baseless and at no point of time, there was any interference as alleged by the petitioners and appropriate steps were taken in accordance with law

ARLR, J W.P.No.2007 of 2017 pursuant to registration of crime on the complaint made by the petitioners and charge sheet was also filed on 03.01.2017. Recording the aforesaid submissions of the learned Government Pleader for Home, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed. No costs.
