HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition Nos.29389, 30180 and 34589 of 2011 COMMON ORDER:
The relief sought for in all these Writ Petitions is for a mandamus to declare the action of the respondents in deducting the crop insurance premium from the crop loans of the petitioners, released and to be released to them, at the rate of 1% to 12% towards crop insurance premium in the Khariff and Rabi Seasons - 2011-2012, as illegal and arbitrary.
By way of interim relief, the petitioners sought a direction to the respondents not to deduct the crop insurance premium from them, in Khariff and Rabi Seasons - 2011-2012 at the rate of 1% to 12% from their loans released and to be released. This Court, by orders in WPMP No.36384 of 2011 in W.P.No.29389 of 2011 dated 03.11.2011; WPMP No.37394 of 2011 in W.P.No.30180 of 2011 dated 15.11.2011; and in WPMP No.43029 2011 in W.P.No.34589 of 2011 dated 29.12.2011, granted interim direction as prayed for. The respondents have not filed their counter-affidavits even as on date.
As a result of the aforesaid interim orders, the insurance premium would not have been deducted from the crop loans extended to the petitioners. As the Khariff and Rabi Seasons 2011-2012 expired more than five years ago, and as crop insurance premium would not have been paid in view of the interim order passed by this Court, no furthers orders are necessary in these Writ Petitions.
All these Writ Petitions are, accordingly, closed. The Miscellaneous Petitions pending, if any, shall also stand closed. No order as to costs. _________________________________ RAMESH RANGANATHAN, ACJ.
