THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.12201 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.

The petitioner was appointed as fair price shop dealer of Shop No.24 of Kondakamarla Village, O.D. Cheruvu Mandal, Anantapur District. While so, basing on the report dated 13.08.2014 of the third respondent-Tahsildar, O.D.

Cheruvu Mandal, the second respondent-Revenue Divisional Officer, Kadiri issued a show cause notice on 14.08.2014 framing two charges against the petitioner. The petitioner submitted his explanation. Thereafter, his authorization was suspended on 10.10.2014. Aggrieved by the same, the petitioner filed Writ Petition No.32463 of 2014 and this Court by an order dated 29.10.2014 suspended the order passed by the second respondent on 10.10.2014. Having regard to the orders of this Court dated 29.10.2014, the second respondent, through orders dated 26.11.2014 reviewed the case of the petitioner and withdrew the suspension orders dated 10.10.2014 by restoring his authorization. Later, another show cause notice was issued along with order of suspension on 10.12.2014 framing three charges against the petitioner.

Challenging the same, the petitioner filed W.P.No.38832 of 2014 and this Court by an order dated 17.12.2014 suspended the orders passed by the second respondent on 10.12.2014. Later, taking a lenient view, the second respondent withdrew the suspension orders of the petitioner dated 10.12.2014 by restoring his authorization.

Now, again basing on the report of the Tahsildar, dated 11.03.2015, the second respondent issued another show cause

notice to the petitioner on 05.04.2015 along with suspension orders framing six charges against him. Aggrieved by the same, the present writ petition is filed.

This Court has carefully gone through the allegations mentioned in the suspension-cum-show cause notice dated 05.04.2015 and in view of the nature of the allegations, this Court is not inclined to interfere with the enquiry process at this stage. In the circumstances, the second respondent-Revenue Divisional Officer, Kadiri is directed to complete the enquiry pending against the petitioner in accordance with law and pass appropriate final orders thereon, within a period of 30 days from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
