THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1167 OF 2015 ORDER:
This criminal revision case under Sections 397 and 401 of the Code of Criminal Procedure is filed by the petitioners/A.1, A.2 and A.5 seeking to set aside the order, dated 24.04.2015 passed in Crl.M.P. (SR) No.5637 of 2014 in C.C.No.1699 of 2012, on the file of the Court of the XI Additional Chief Metropolitan Magistrate, Secunderabad, whereby the Court below dismissed the petition filed by the petitioners herein for recalling the Non Bailable Warrants (NBWs) issued against them.
Heard and perused the material.
Learned counsel for the petitioners submits that on 17.10.2014, when the case was called, the counsel representing the petitioner before the Court below could not enter the court hall due to the crowd in the court hall corridor and immediately when the counsel reached the bench, he represented the matter and brought to the notice of the Court below that he was being prevented from entering into the court due to the crowd near the entrance and that it was his mistake, but not of the petitioners.
Learned counsel for the petitioners submits that even though the counsel representing the petitioners before the Court below brought to the notice of the Court below the reasons for not appearing before the Bench when the case was called, the Court below erroneously issued NBWs to the petitioners, and as such, prays this Court to recall the NBWs issued against the petitioners. In view of the facts and circumstances, the petitioners/A.1, A.2 and A.5 are directed to surrender and file an application for recalling NBWs issued against them before the Magistrate concerned within a period of fifteen days from today and on such surrender and filing of an application, the trial Court is directed to recall the NBWs issued against the petitioners/A.1, A.2 and A.
the petitioners/A.1, A.2 and A.5 are directed to execute personal bonds for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for a like sum to the satisfaction of the said Magistrate for future appearance.
The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
