THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7973 OF 2016 ORDER:

This petition is filed by the petitioner-A1 under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.50 of 2016 on the file of Musunur Police Station, Krishna District, registered for the offences punishable under Sections 323, 420 and 506 IPC and 3(1)(x) of SCs & STs (POA) Act, 1989.

The case of the prosecution is that the de facto complainant borrowed amount from the petitioner for the educational expenses of his children and when the de facto complainant intends to sell his land for repaying the amount borrowed from the petitioner, the petitioner agreed to purchase the land of the de facto complainant by paying the remaining amount. But, when the de facto complainant, his wife and his daughter went the house of the petitioner for asking the money, which the petitioner agreed to pay for purchasing the land, the petitioner abused them in the name of their caste and also beat them. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against them and to grab the money from the petitioner, he was implicated in the present case with false allegations.

The learned Additional Public Prosecutor submitted that in view of bar under the provisions of the SC & ST Act, this petition is not maintainable.

Considering the facts and circumstances of the case and in view of the submissions made by the learned Additional Public Prosecutor, this Court is of the view that this petition is not maintainable.

Accordingly, the Criminal petition is dismissed. ______________ RAJA ELANGO, J June 16, 2016.
