THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7596 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.1 in the event of his arrest in Crime No.358 of 2021 on the file of Station House Officer, Subedari Police Station, Warangal Urban registered for the offence punishable under Section 304-B read with Section 34 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act.

Heard learned counsel for the petitioner/Accused No.1 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

Learned counsel for the petitioner submits that the petitioner is a resident of Oman country and he is arrayed as Accused No.1 in the crime registered for the offence under Section 304-B read with Section 34 of IPC and Sections 3 and 4 of DP Act. He further submits that the investigation is completed and filed charge sheet.

For the reason of the investigation being complete, the petitioner undertakes to surrender before the concerned Court on 07.09.2022 and also undergo the process of trial. In view of the criminal Court proceedings to be undertaken, this petitioner can be granted the relief of anticipatory bail and the petitioner/Accused No.1 shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused No.1 is directed to surrender before the concerned Court on 07.09.2022, and on such surrender, the petitioner/Accused No.1 shall be enlarged on bail on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh Only) with two sureties to the like sum each to its satisfaction. In the event of the petitioner/Accused No.1 failed to surrender before the concerned Court on the said date, the bail granted to this petitioner/Accused No.1 shall remain cancelled. ii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. iii) The petitioner/Accused No.1 shall surrender his passport before the said Court.

Accordingly, the Criminal Petition is allowed. Needless to say the petitioner can be permitted to travel only at the instance of the trial Court.
