THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.18705 of 2007 ORDER:

This writ petition is filed seeking a writ of mandamus to declare the action of the 4th respondent to discontinue the services of the petitioners as cooks engaged for 'Mid-Day meals' programme as illegal.

This Court, while admitting the writ petition on 05.09.2007, granted interim direction to continue the services of the petitioners pending disposal of the writ petition, as prayed for in WPMP No.24035 of 2007.

At the hearing, the learned counsel for the petitioners would submit that pursuant to the interim direction, the petitioners are continuing in services and that the interim order worked out for itself and that if the writ petition is disposed of making the interim order the final order, it would sub-serve the ends of justice. Though no counter-affidavit has been filed, the learned Government Pleader representing the respondents 1 to 4 would submit that in view of the compliance of the interim orders, the writ petition can be disposed of as desired by the petitioners. However, she further submits that the authorities concerned may be reserved liberty to proceed against the petitioners in accordance with the rules of service governing their appointment. Recording the submission of the learned counsel for both the sides, the writ petition is disposed of in terms of the interim order

MSRM, J W.P.No18705 of 2007 dated 05.09.2007 in WPMP No.24035 of 2007, reserving liberty to the authorities concerned as indicated supra. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
