HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13668 of 2002 ORDER:

This writ petition is filed seeking the following prayer: "to issue a writ, order or direction more in the nature of a writ of Mandamus directing the respondent No.1 not to initiate disciplinary action against the petitioner herein only on the ground that he is not residing in the University campus by declaring the action of the respondents in doing so as contemplated in memo No.23552/OP/A3/02, dated 18.07.2002, passed by the 1st respondent as illegal and pass such other order or orders as this Hon'ble Court may deems fit and proper under the circumstances of the case."

This Court, while admitting the writ petition on 29.07.2002 granted interim stay and the same was vacated on 31.01.2003 stating that the petitioner was required to stay in the quarters allotted to him in the University to attend to the emergency works.

Admittedly, the petitioner was aged 49 years at the time of filing of the writ petition. Now, the petitioner might have retired from the service. As such, the cause in the writ petition does not survive for adjudication. Even on the merits also, the petitioner is supposed to stay in the quarters allotted to him in the University to attend emergency works. Hence, I do not see any merit in the writ petition. Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions, pending if any, shall stand closed.
