THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7606 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in connection with Crime No.215 of 2022 on the file of Nallakunta Police Station, Hyderabad District, registered for the offences punishable under Section306 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against this petitioner is that she gave loan amount of Rs.80,000/- to the husband of the defacto complainant. After giving the said amount the petitioner allegedly went to the shop of the deceased continuously over a period of time and quarreled to return the said amount. The victim was depressed due to the acts of the petitioner and committed suicide.

Even according to the complaint, there are money transactions and for the reason of repayment of the loan amount of Rs.80,000/- which was given by this petitioner, the petitioner had approached the deceased asking to repay.

In the said circumstances, the petitioner who is in jail since 14.07.2022 can be granted the relief of bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of V Additional Metropolitan Sessions Judge at Hyderabad. ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer, on every Monday between 10.00 A.M. to 1.00 P.M. for a period of six weeks, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
