Heard counsel for petitioners and the Government Pleader attached to the Office of the Additional Advocate General appearing for respondents.

Petitioners contend that objections filed by them in January and February, 2018 under Section 15(2) of the Act 30 of 2013 have not been considered by the 6th respondent and Declarations under Section 19 of Act 30 of 2013 have been issued on 30.04.2018, 21.05.2018, 31.05.2018. It is also their specific contention that they had sought details about the project for construction of Gouravelli Reservoir in Telugu and the same has not been furnished to the petitioners.

The Government Pleader attached to the Office of the Additional Advocate General appearing for respondents does not dispute the contention of the petitioners that documents as sought in Telugu about DPR, etc., have not been furnished to the petitioners. He also does not dispute the fact that objections filed by the petitioners were not properly considered by the 6th respondent. He states that the Court may fix time for furnishing of material sought by the petitioners and consideration of the same on a specific date by the 6th respondent, so that the execution of the project is

not stayed indefinitely. He however contended that the order be confined only to the petitioners, who have approached this Court.

In view of the submissions made by the Government Pleader attached to the Office of the Additional Advocate General, the Writ Petition is allowed to the extent that the declarations dt.30.04.2018, dt.21.05.2018, and dt.31.05.2018 issued under Section 19(1) of the Act 30 of 2013 are set aside as regards the petitioners and subsequent proceedings as regards are also set aside. The 6th respondent is directed to furnish the material sought by the petitioners regarding the project in Telugu i.e. DPR, etc. on or before 27.07.2018; petitioners are directed to submit their fresh objections if any on the basis of the material furnished by the 6th respondent on or before 17.08.2018; the 6th respondent shall conduct personal hearing to the petitioners or their counsel on 24.08.2018 at 10.30 a.m., at his office; and then communicate his decision on the objections to the petitioners within a period of four (04) weeks thereafter. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
