HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 21209 of 2015 ORAL ORDER:

Heard learned counsel for petitioner, learned Assistant Government Pleader for Panchayat Raj and learned standing counsel for fourth respondent Gram Panchayat and with their consent, the writ petition is taken up for disposal at the admission stage.

Petitioner herein the elected ward member of Arigipalem Gram Panchayat and alleges that Sarpanch of the Gram Panchayat-third respondent is not discharging her duties as per the rules and committing several irregularities under the influence of her husband. She along with other members of the Gram Panchayat submitted a representation dated 26.7.2014 to District Collector-second respondent indicating the illegalities and irregularities committed by the third respondent. Since no action is forthcoming on the said representation, the present writ petition is filed. Having regard to fact that the representation of the petitioner dated 26.7.

2014 is pending consideration before the District Collector-second respondent, without expressing any opinion on the merits of the matter it would suffice to dispose of writ petition directing second respondent to consider and dispose of representation of petitioner dated 26.7.2014 in accordance with law within a period of four weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. It is needless to mention that if competent authority intend to proceed against third respondent, prior notice and opportunity of hearing be afforded to him. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
