The present civil revision petition is filed under Article 227 of the Constitution of India aggrieved by the order dated 06.04.2017 passed in I.A.No.86 of 2017 in O.S.No.1 of 2013 on the file of XI Additional District Judge, Piler, wherein an application filed by the petitioner for appointment of an Advocate Commissioner for recording the cross examination of the petitioner was rejected. 3.
Though various grounds are raised, learned counsel for the petitioner mainly submits that in view of the fact that the petitioner is suffering with acute arthritis, could not travel and hence seeks appointment of an Advocate Commissioner. He placed on record the medical certificate, said to have been issued by the Civil Assistant Surgeon Specialist, Government Headquarters Hospital, Chittoor, in support of his plea. At the same time, it is also brought to the notice of this Court that the said medical certificate was not placed before the trial Court, while making such a request. 4.
Having regard to the above, the present revision is disposed of directing the petitioner to make fresh application seeking appointment of an Advocate Commissioner, along with medical certificate dated 15.04.2017, in which event, the said Court shall consider the same after due verification and pass orders thereon, in
accordance with law. It is needless to mention that the evidence to be adduced by the plaintiff may not be closed today. No costs. As a sequel thereto, Miscellaneous Petitions, if any, pending, shall stand closed.
