THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.6051 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners / A.4 and A.5 in C.C.No.427 of 2014 on the file of the Court of the Judicial First Class Magistrate, Rajam, Srikakulam District.
2 When the matter is taken up for hearing, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw the petition with liberty to avail the remedies available to them under law, including filing of a petition for discharge before the trial Court. He further requested that the presence of the petitioners before the trial Court may be dispensed with on each and every date of adjournment. There is no dispute with regard to the identity of the petitioners. Permission is accorded. In the result, this Criminal Petition is dismissed as withdrawn granting the liberty as prayed for. The presence of the petitioners / A.4 and A.5 before the trial Court on each and every date of adjournment is dispensed with. However, they shall appear before the trial Court as and when their presence is so required.
