Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner is a fair price shop dealer of shop No.6, Vedurukuppam Mandal, Chittoor District. While so, the authorization of the petitioner was kept under suspension by the orders of the third respondent dated 26.11.2014 on the basis of the representation submitted by the fourth respondent. Challenging the same, the petitioner filed W.P.No.38465 of 2014 and the same was disposed of on 15.12.2014 based on which the authorization of the petitioner was restored on 31.12.2014. Later on the authorization of the petitioner was kept under suspension by proceedings of the third respondent dated 31.03.2015 on the ground of certain irregularities. Against the said order, the petitioner preferred an appeal with the second respondent who disposed of the same on 25.04.

2015 directing the third respondent to complete the enquiry and till completion of the enquiry, the suspension of the authorization was set aside. The petitioner submitted his explanation, and after considering the same, the third respondent passed an order on 06.06.2015 canceling the authorization of the petitioner. Challenging the same, the present Writ Petition is filed.

3. Since there is a remedy of appeal against the impugned order, this Court is not inclined to go into the merits of the impugned order. However, since the authorization of the petitioner was restored consequent to the orders passed by the second respondent, but the same was again cancelled by the order of the third respondent dated 06.06.2015, the authorization shall be continued till the disposal of the appeal to be preferred by the petitioner within a period of 15 days from the date of receipt of a copy of this order. After receipt of appeal from the petitioner, the second respondent shall consider the same and pass appropriate orders by observing the principles of natural justice within a period of three months thereafter.

4. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _______________________________ A. RAMALINGESWARA RAO, J Date: 19.06.2015 TJMR
