THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.10629 of 2025 ORAL ORDER:

Seeking the Court to enlarge the petitioner, who is arrayed as accused in Crime No.477 of 2025 of Nacharam Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 85 and 108 of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'), on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 27.07.2025, defacto complainant lodged a report stating that he had performed the marriage of his deceased daughter with the accused on 30.04.2025, and that their relationship was initially cordial. However, the deceased later informed her family that her husband was harassing her physically and mentally, frequently returning home late, hosting parties, and verbally abusing her by saying she could either stay or die, and that he could easily find other women. Despite the attempts of his family to intervene, the harassment continued. A few days prior to her death, the deceased injured her left

hand with a knife due to the ongoing abuse. The family had planned to hold a panchayat to address the issue, but before it could take place, the deceased, who was emotionally sensitive and depressed, allegedly committed suicide due to the unbearable torture inflicted by her husband, as such the complainant requested that necessary legal action be taken against the accused. Based on the complaint, a case was registered against the accused for the aforementioned offences.

Heard Sri Baglekar Akash Kumar, learned counsel appearing for the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and that there is no act of abetment on the part of the accused to drive the deceased to commit suicide, as such Section 108 of the BNS is not applicable to the present case, and the petitioner has no connection with the alleged offences. He further submitted that the petitioner was arrested on 27.07.2025, and that the substantial part of the investigation has already been completed. Therefore, he

prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are of a serious nature and that within four months of her marriage, the deceased committed suicide as a result of the petitioner's alleged abetment. He further stated that the investigation is in progress and if the petitioner is released on bail, at this stage, he may tamper with the evidence and may threaten the witnesses. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it is observed that the petitioner is in jail from 27.07.2025 and as the material part of the investigation is completed including examination of 14 witnesses and considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties for a like sum each to the satisfaction of the learned I Additional Junior Civil Judge-cum-IV Additional Metropolitan Magistrate, MedchalMalkajgiri District Uppal at L.B.

Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 A.M., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 483(3) of BNSS.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
