Yellaboina Bhadraiah v. The State Of Telangana And 6 Others
THE HONOURABLE SRI JUSTICE P.NAVEEN RAO W.P.No. 26324 of 2019 ORDER :
Heard learned counsel for petitioner and learned Government Pleader for Revenue for respondents.
2.
Petitioner claims to be owner and possessor of land to an extent of Ac.1-00 in Sy.No.189/15/4 situated at Nayakalagudem village, Yellandu mandal, Bhadradri-Kothagudem district. According to petitioner, initially the said land was allotted in favour of his father and after the death of his father, he succeeded over the said land and his name is entered in the revenue records and he was also issued with pattadar passbook, 1-B certificate and his name was also reflected in the pahani for the year 2018-19. 3.
While so, petitioner alleges that without any justification, the unofficial respondents are damaging the crop of petitioner. It appears, petitioner complained to the 2nd respondent-District Collector alleging that unofficial respondents have entered into his paddy fields and damaged his crop and requested him to take action. The District Collector, in turn, by letter dated 21.8.2019 directed the 4th respondent-Tahsildar to look into the grievance of petitioner on the above allegation. The 3rd respondent-Revenue Divisional Officer also vide letter dated 17.8.2019, requested the 4th respondentTahsildar to take action in accordance with Rules and procedure. It appears, petitioner also caused legal notice and in response vide letter dated 9.9.2019, the 3rd respondent-RDO directed the Tahsildar to conduct a detailed enquiry into the matter and take appropriate
action as warranted by law. Alleging inaction on the same, the present writ petition is filed.
4.
It appears that the petitioner has serious grievance against unofficial respondents in entering into his land and damaging the crop. It is not a case of violation of provisions of Act 9/77. It is therefore a private dispute between individuals and the authorities of the State have no role to interfere in such matters. Therefore, the relief sought for in the writ petition cannot be granted. Leaving it open to the petitioner to work out his remedies against the alleged illegal interference of unofficial respondents into his land, this writ petition is dismissed. As a sequel, the miscellaneous petitions, if any, shall stand closed.
