THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9482 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 and 2 in Crime.No.51 of 2023 on the file of Thimmajipet Police Station, Nagarkurnool District, registered for the offence under Section 302 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case against these petitioners is that on 09.04.2023, they had caused the death of the deceased. The deceased was the brother of A-1. A-1 and the deceased were having differences, for which reason, A-1 planned to kill the deceased with the help of A-2 and A-3. Accordingly, the deceased was called for consuming toddy and after consuming toddy, A-3 caught hold of the legs of the deceased

and these petitioners/A-1 and A-2 suffocated the deceased to death.

The investigation is complete and the petitioners are in jail since 05.07.2023, the relief of regular bail to the petitioners can be considered, subject to following conditions:

i) The petitioners/Accused No.1 and 2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of Principal District and Sessions Judge at Nagarkurnool.

ii) The petitioners/Accused Nos.1 and 2 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioners/Accused No.1 and 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
