Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop N o . 9 , Peddagogulapalli Village, Chandrasekharapuram Mandal, Prakasam District. The shop of the petitioner was inspected by the Enforcement Deputy Tahsildar, Kanigiri on 29.06.2015 and a show cause notice was issued by the third respondent to the petitioner on 14.07.2015. The petitioner sought for copy of the report from the third respondent, by her letter dated 23.07.2015. The third respondent issued another show cause notice to the petitioner on 21.08.2015 and the petitioner submitted another petition on 27.08.2015 requesting to furnish the information.

However, the authorization of the petitioner was cancelled on 26.08.2015 on the ground that though the petitioner took xerox copies of the registers on 17.07.2015 and 23.08.2015, she did not submit any explanation and did not produce authorization at the time of inspection. Challenging the same, the petitioner preferred an appeal to the second respondent. However, the order of cancellation itself is challenged in the present writ petition.

3. In view of the pendency of appeal before the second respondent, this Court is not inclined to interfere with the enquiry.

4. In the circumstances, the writ petition is disposed of directing the second respondent to take up the appeal and dispose of the same in accordance with law within a period of three months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. _______________________________
