THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON No.22595 OF 2017 ORDER:

The prayer sought in the writ petition is as under: 'For the reasons stated in the accompanying affidavit, the petitioner prays that the Hon'ble Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the official respondents in trying to disburse the land compensation amount of acquisition of the petitioner's land an extent Ac.3.08 Gts., in Sy.Nos.127/12, 127/13, 127/14/2, 127/14, 127/15 and land an extent Ac.1.07 in Sy.Nos.127/453 situated at Sandrallabodu Village, Amerda Gram Panchayat, Aswapuram Mandal, Bhadradri Kothagudem Dist to the unofficial respondent as illegal, arbitrary, unreasonable, and consequently direct the official respondents not to disburse the compensation of the land acquisition amount till the adjudication of dispute between petitioner and unofficial respondent and pass such other order/s as this Hon'ble Court deem fit and proper in the circumstances of the case.'

The second respondent Corporation filed a counter-affidavit stating that notices were issued to the petitioner as well as the third respondent calling upon them to submit/produce the respective documents for examining the issue vide Memo No.B/41/2016 dated 13.12.2017. However, the petitioner has not attended on the said date but the third respondent attended on the said date and produced PPB/TD No.154441 vide I-B Khata No.531 to an extent of Ac.4.29 guntas in Sy.No.127/40 which is related to assignment patta issued in VII Phase vide Tahsildar, Aswapuram, bearing File No.B/1000/2013 dated 02.01.2014 and the said extent of land is coming under alignment. The petitioner neither attended the office nor submitted any documents in support of his claim.

In the light of the Memo issued by the second respondent vide Memo No.B/41/2016 dated 13.12.2017, the petitioner has to work out his remedies before the second respondent.

Accordingly, the writ petition is closed giving liberty to the petitioner to raise his objections before the second respondent pursuant to the Memo No.B/41/2016 dated 13.12.2017.
