HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 1216 of 2017 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the third respondent in not renewing the petitioner's society as arbitrary, capricious, discriminate, illegal and bad in law; and direct the third respondent to renew the petitioner's society as per the application dated 06.09.2016.

3) Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the third respondent to consider the representation dated 06.09.2016.

4) The Government Pleader for Revenue submits that if the said application is still pending consideration, the authorities may be directed to consider the said representation in accordance with law.

5) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the third respondent to pass

orders on the representation dated 06.09.2016, in accordance with law, as expeditiously as possible, preferably within a period of six (04) weeks from the date of receipt of the order, if the same is made and still pending consideration. It is needless to mention that the third respondent shall hear the petitioner as well as the aggrieved persons if any, before passing the order. No order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
