HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.4966 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Home for respondents 1 to 4 and recorded the personal appearance of the Assistant Commissioner of Police3rd respondent and the SHO, SR Nagar-4th respondent and perused the part-I case diary and perused the prayer in the writ petition with the supporting affidavit and the written instructions. In support of the prayer, it is the grievance of the petitioner from the affidavit contents vis-à-vis oral submissions that there is deliberate inaction on the part of the respondents not only in registering the crime from the report received on 31.01.2017, but also in completing the investigation.

As per the written instructions the crime is already registered and investigation is in progress and it is the submission that investigation will be completed soon.

Having regard to the above and by recording the same, the Writ Petition is disposed of by directing the 4th respondent-SHO to complete the investigation and file final report under Section 173 CrPC within one month from the date of receipt of this order by intimating the same to the defacto complainant. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
