O R D E R

Vide Lr.No.3/ C27/ 13478/ 2019 dated 05.08.2019, the 3rd respondent - Greater Hyderabad Municipal Corporation, represented by its Assistant City Planner, Town Planning Section, Circle 27, returned the building permission application of the petitioner, pointing out certain shortfalls and the petitioner was also required to produced NOC from the revenue authorities. Aggrieved by the action of the 3rd respondent in seeking produce NOC from revenue authorities, the present writ petition is filed. Heard the learned counsel for the petitioner as well as Sri Chatla Madhu, learned Standing Counsel for respondents 2 and 3, and the learned Assistant Government Pleader for Municipal Administration, appearing for 1st respondent.

In view of the judgment of this court in HYDERABAD POTTERIES PRIVATE LIMITED v. COLLECTOR, HYD.1 production of NOC from the revenue authorities is not required, and the application of the petitioner for grant of building permission, has to be considered in accordance with law.

In view of the above facts and circumstances, the writ petition is disposed of directing the respondents 2 and 3 / competent authority, to consider the application of the petitioner for grant of building construction in accordance with law, without insisting for 'NOC' from revenue authorities. However, it is needless to observe that petitioner shall comply with other short falls pointed out in the letter dated 05.08.2019. 1 2001(3) ALD 600

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
