THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.206 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-A.3 to A.5 under Section 482 Cr.P.C., to quash the proceedings in S.C.No.31 of 2014 pending on the file of V Additional District Judge-cum-Special Judge for SC/ST (POA) Cases, Nellore for the offences under Sections 452, 353 r/w 34 IPC and Section 3(1)(x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Heard and perused the material available on record. The above S.C.No.31 of 2014 is arising out of Crime No.69 of 2010 on the file of Police Station Vidvalur, Nellore District. Even at the crime stage, one of the accused i.e.Sarvepalli Madhavi, Village Revenue Officer, approached this Court invoking the provision under Section 482 of Cr.P.C. by filing Crl.P.No.12920 of 2010 seeking to quash the proceedings in the said crime. This Court by order dated 24.7.2013 allowed the said Criminal Petition quashing the proceedings as against her. The petitioners herein who are arrayed as A.3 to A.5 in the S.C. are also standing on the same footing with that of the petitioner in Crl.P.No.12920 of 2010 and hence, the proceedings in the said S.C. are liable to be quashed as against them in terms of the orders passed in the said Criminal Petition. In the result, the Criminal Petition is allowed and the proceedings in S.C.No.31 of 2014 pending on the file of V Additional District Judge-cumSpecial Judge for SC/ST (POA) Cases, Nellore are hereby quashed as against the petitioners herein.

Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
