THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7613 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A2 in connection with C.O.R.No.146 of 2022 on the file of Prohibition and Excise Police Station, Bhadrachalam, Bhadradri-Kothagudem District, registered for the offences punishable under Section 8(c) read with 20(b)(ii)(B) of NDPS Act, 1985.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against this petitioner is that he was found in possession of 7 Kgs of dry ganja by the Bhadrachalam Excise Police and arrested and remanded on 10.06.2022. 4.

On instructions, learned Assistant Public Prosecutor submits that there are no other pending cases against this petitioner .

Keeping in view that the petitioner is a student and also the contraband involved is less than the commercial quantity, this

petitioner can be granted the relief of bail subject to the following conditions:

i) The petitioner/A2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Bhadrachalam, Bhadradri-Kothagudem District.

(ii) The petitioner/A2, after release shall appear before the concerned Station House Officer, on every Monday and Thursday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks, for the purpose of investigation. iv) The petitioner/A2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
