THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 3426 of 2015 ORDER :

The petitioner, who is accused No.3 in Crime No.241 of 2014 of Cyber Crime Police Station, Cyberabad, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime registered against him and others for the offences punishable under Sections 468, 471, 419, 420, 120-B IPC and Sections 66-C & 66-D of Information Technology Act, 2000. Though the present application is filed under Section 438 Cr.P.C., learned counsel for the petitioner restricts his prayer seeking a direction to the trial Court to consider the bail petition filed by the petitioner, on his surrender, at the earliest. Learned Additional Public Prosecutor, on instructions, submits that A.1 and A.2 were arrested and released on bail on the same day.

Having regard to the circumstances stated above, the petitioner, if so advised, shall surrender before the concerned Court and move an application for bail before the appropriate Court after giving prior notice to the Public Prosecutor in which event the same shall be dealt with, in accordance with law, either on the same day or at the earliest.
