THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7628 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in connection with Crime No.444 of 2022 on the file of Chandrayangutta Police Station, Falaknuma Division, South Zone, Hyderabad, registered for the offences punishable under Section 498-A and 306 of Indian penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he is the husband of the victim who committed suicide by consuming poison unable to bear the harassment of this petitioner. The main allegation against the petitioner is that as Victim did not conceive, the petitioner was harassing the victim.

Learned Counsel for the petitioner submits that for the reason of the Victim not able to conceive, she had committed suicide and there was never any harassment as stated in the complaint.

The petitioner is in jail since 02.08.2022 and all the material witnesses are examined. Since the case is one of matrimonial disputes pursuant to which the wife had taken the extreme step of committing suicide, the petitioner can be granted the relief of bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees fifty Thousand only) with two sureties for a like sum each to the satisfaction of Chief Metropolitan Magistrate, Metropolitan Criminal Courts, Nampally at Hyderabad.

ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer, on every Monday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks, for the purpose of investigation. iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
