HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9609 of 2017 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. by petitioners/ accused seeking to quash the proceedings in C.C.No.209 of 2016 (old C.C.No.2207 of 2016) on the file of the XV Special Magistrate, Erramanil, Hyderabad Heard.

A perusal of the order of the learned Magistrate itself is very clear of all defences available to consider in the trial, as trial already commenced, thereby, there is nothing to interfere with the said order of the learned Magistrate, much less, to say the self same the order of the lower Court once supported by cogent reasons, that too, when all the defences of the petitioners/ accused are left open during trial to consider. Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
