THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.27949 of 2015 ORDER:
In this Writ Petition, the petitioner challenges the order dt.25.07.2015 of respondent No. 2, whereunder the 2nd respondent cancelled all the papers of B.E. 1st year II Semester (ECE) main examination in which the petitioner had appeared on the alleged ground that the petitioner had indulged in mal-practice.
2. Although learned counsel for the petitioner contended that this order cannot be sustained because the petitioner had no prior knowledge of the manuscript which was lying near him and that Malpractice Committee members spoke in vernacular language which is not understood by the petitioner, since the petitioner had himself executed a letter dated 27.05.2015 addressed to the Director of Evaluation of the 2nd respondent admitting that he had indulged in copying in one of the subjects i.e. environment science, the impugned order cannot be interfered with.
3. Although learned counsel for the petitioner stated that the petitioner has served with show cause notice only on 24.07.2015 and did not have time to defend himself, I am not willing to accept the said contention since the
petitioner is a major and is fully aware of the implications of his conduct. Therefore, I do not find any merit in the Writ Petition.
3. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
