HON'BLE SRI JUSTICE S. RAVI KUMAR C.M.A.No.110 of 2010 JUDGMENT:

This appeal is preferred questioning order dated 22.06.2009 in I.A.No.578 of 2009 in A.S.No.14 of 2009 on the file of III Additional District Judge, Kurnool at Nandyal.

2. First respondent herein preferred A.S.No.14 of 2009 challenging the dismissal of his suit and in that appeal, he filed I.A.No.578 of 2009 seeking injunction pending disposal of the appeal. Appellate Court on consideration of contentions and rival contentions of both parties granted status quo pending disposal of the appeal. Aggrieved by the same, some of the defendants i.e., defendants No.2, 5 and 6 preferred the present appeal.

3. As seen from the office note, main appeal was dismissed on 24.11.2011 and in view of the dismissal of the appeal, orders granted in I.A.No.578 of 2009 are no more in fore.

4. Though this appeal is posted under the caption 'Specially identified cases', neither advocate for appellants is present nor any representation is made on behalf of appellants.

6. Considering these aspects, I am of the view that

appellants have not evinced any interest in prosecuting the case.

For these reasons, this Civil Miscellaneous Appeal is dismissed for non-prosecution.

No costs.

Miscellaneous Petitions, pending in this Appeal, if any, shall stand closed.
